Once your processing is complete, you can easily pick it up and receive your developed images on a PhotoCentre USB containing digital copies. 

Harvey Norman Film Processing Services Terms & Conditions

These terms and conditions (“Terms”) govern the provision of film processing services by Harvey Norman Stores (N.Z) Pty Limited (“Harvey Norman”, “we”, “our” or “us”) to you. By submitting film to us for processing, you agree and accept these Terms. Please review them carefully.

1.          Services

1.1.      Harvey Norman offers film processing services including developing, scanning and printing of photographic film (“film processing services”). 

1.2.      To provide high quality film processing services, we engage a trusted third-party partner (“Fulfilment Partner”) to process and develop your film, and scan a copy of images onto USB. 

1.3.      In providing these film processing services, we use a third-party delivery agent to transport your film to and from our Fulfilment Partner. While we use reasonable efforts to ensure that our delivery agent exercises reasonable care, skill and diligence to ensure the safe handling and transportation of your film to and from our Fulfilment Partner, by submitting your film to us for processing, you acknowledge and accept, to the maximum extent permitted by law, we are not liable for any loss, delay or damage occurring during transit. 

2.          Acknowledgment

2.1.      By submitting your film for processing, you acknowledge and agree that:

(a)       you are the legal owner of the film and the content, and have the right to submit the film for processing;

(b)       the content does not breach any laws or infringe the rights of any third party;

(c)       you have read and understood these Terms.

3.          Your Responsibilities

3.1.      You are responsible for providing accurate and complete information when placing an order for film processing with us. 

3.2.      You must ensure that you comply with our requirements for film types and formats. If you are unsure whether your film meets our requirements, please contact us before placing an order.

3.3.      You agree to pay the full amount for film processing services as outlined in an invoice.

4.          Payment and Processing Times

4.1.      You are required to make full payment for film processing services prior to the commencement of any processing work. 

4.2.      Upon receipt of payment, Harvey Norman will confirm the order and provide an estimated timeframe for the completion of the processing services. 

4.3.      No refunds will be provided once processing has begun, except in cases where the film processing service cannot be completed due to unforeseen circumstances. 

4.4.      The standard processing timeframe for film is provided for guidance only and may vary depending on the type of film, volume of orders, technical issues or specific service requirements. While we will take reasonable steps to meet these processing timeframes, we cannot guarantee these timeframes, due to circumstances outside of our and our Fulfilment Partner’s control. Accordingly will not be liable for any delays. 

4.5.      In the event of any unforeseen delays to the standard processing timeframes, we will notify you by phone or email. 

5.          Ownership and Copyright

5.1.      You retain ownership and copyright of all films and images. However, by submitting your films to Harvey Norman for processing, you grant us a limited, non-exclusive right to use, reproduce and process your films solely for the purpose of the services requested by you. 

5.2.      All films submitted to Harvey Norman for processing remain your property. We do not claim any ownership rights over your films, negatives or images.

6.          Retention of Images and Negatives

6.1.      As part of the film processing services, negatives (processed film) will not be returned to you unless requested by you at the time of placing your order. 

6.2.      Negatives and digitised images will be retained by our Fulfilment Partner for twenty one (21) days from the date of processing, after which time, any unclaimed negatives and digital images will be securely disposed or deleted. If you wish to obtain your negatives or digital images, you are responsible for collecting them directly from our Fulfilment Partner during this period. To the maximum extent permitted by law, Harvey Norman and our Fulfilment Partner accepts no responsibility for negatives and digital images after this time period.

7.          Compliance with Laws

7.1.      By submitting film for processing, you acknowledge that the content of the film does not infringe any laws or intellectual property rights of others, including copyright and privacy laws. 

7.2.      You agree that the film submitted for processing does not contain any illegal or offensive material, or violates the rights of any third party.

7.3.      Harvey Norman and its Fulfilment Partner, reserves the right to refuse processing of any film that is suspected or determined to contain illegal material or in breach of any laws. If we refuse to process your film, we will notify you promptly and provide reasons. The films will be returned to you.

7.4.      If during film processing, we discover material that is illegal or is breach of any laws, we may be required to report the contents to the appropriate authorities. By submitting your films, you acknowledge and agree to this.

8.          Privacy and Confidentiality

8.1.      We are committed to protecting your privacy in accordance with the Privacy Act 2020. All personal information collected from you will only be used for the purpose of fulfilling your film processing order. All images processed remains confidential and will not be shared, published, or used for any other purpose without your consent. 9.          Image Quality

9.1.      Harvey Norman and its Fulfilment Partner commits to processing film using industry-standard techniques and equipment to ensure the highest quality images from the processed film. However due to the inherent nature of film processing, slight variations in colour, contrast and sharpness may occur. 

9.2.      You acknowledge that the quality of the final images may be influenced by such factors as the condition of the original film (film expiry and storage conditions), the type of film used, exposure techniques and camera function, and processing techniques. Harvey Norman does not guarantee specific results or image quality and is not responsible for images affected by poor shooting conditions, expired film, or camera malfunction. 

10.       Damage or Loss of Film

10.1.   While we, our Fulfilment Partner and delivery agent, take utmost care in handling, processing and transporting your film, there is always a risk of damage due to the nature of the materials, processes involved and transportation risks. To the maximum extent permitted by law, Harvey Norman, its Fulfilment Partner and delivery agent, are not liable for any:

(a)       damage to films that occur due to pre-existing conditions such as age, improper storage or previous handling by the customer;

(b)       lost, damaged or delayed film due to third party service providers;

(c)       accidental loss or damage to film during processing;

(d)       loss or damage to film during transportation to and from our stores.   

11.       Indemnity

11.1.   Nothing in these Terms is intended to limit or exclude any rights, obligations or guarantees that cannot lawfully be limited or excluded under the Consumer Guarantees Act 1993 (“CGA”) If, and to the extent that any liability we purport to limit or exclude cannot be lawfully limited or excluded, these Terms shall be modified to the extent necessary to give effect to the above intention. We do not provide any express guarantees (as that term is defined in the CGA) other than those expressly confirmed in these Terms or supplied to you in writing when you purchase film processing services from us. 

11.2.   You agree to indemnify Harvey Norman, our officers, employees, Fulfilment Partner and agents, from and against all liability, damages, losses, penalties, fines, expenses and costs (including legal costs) arising out of or in connection with your breach of these Terms or applicable law, or any claims related to the content of the film submitted by you including, without limitation, allegations of copyright infringement, or violation of privacy right. 

12.       Limitation of Liability

12.1.   In the unlikely event of loss or damage caused directly by our film processing services, to the maximum extent permitted by law, Harvey Norman’s liability, if any, is limited to the cost of the film processing service provided or the replacement of the film. Harvey Norman will not be liable to you, in contract, tort (including negligence), breach of statutory duty or otherwise in respect of any claims relating to the provision of film processing services for any consequential or incidental loss or damages, (direct or indirect) including but not limited to loss of revenues, loss of data or data use, loss of memories, loss of income or wasted expenditure. 

13.       Amendments to Terms

13.1.   We reserve the right to update these Terms at any time, at our discretion. Any amendments will be effective immediately and will apply to any film processing order you place from the effective date of change. We recommend reviewing these Terms before placing an order, to understand the terms that apply to you.

14.       Governing Law

14.1.   These Terms shall be governed by, and construed in accordance with the laws of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Zealand to resolve any dispute arising in relation to these Terms.
